Komnas HAM must investigate alleged Sinak torture case: LP3BH Manokwari


Jubi TV – Executive Director of the Manokwari Institute for Research, Assessment, and Development of Legal Aid (LP3BH) Yan Cristian Warinussy has called for an investigation of the alleged persecution of seven children in Sinak District, Puncak Regency, Papua Province.

“I agree there must be an investigation into the alleged torture of seven children in Puncak’s Sinak District by members of the Indonesian Military (TNI),” Warinussy said in Manokwari on Sunday, March 6, 2022.

Warinussy, who is also the spokesperson for the Papua Peace Network (JDP), cited Coordinator of the Commission for Missing Persons and Victims of Violence (KontraS) Fatia Maulidiyanti, saying one of the victims of the persecution named Makilon Tabuni was suspected to have died.

Investigations of alleged human rights violations are strongly stipulated in Law No. 39/1999 on Human Rights and Law No. 26/2000 on the Human Rights Court.

“Therefore, I as the Executive Director of LP3BH Manokwari, urge the National Human Rights Commission (Komnas HAM) to immediately investigate allegations of human rights violations in Sinak, where seven children have been allegedly abused,” he said.


The legal basis for Komnas HAM investigations, Warinussy said, was Article 7 Letter b and Article 9 Letter a and f of Law No. 26/2000 on the Human Rights Court. It is strongly suspected that the torture of the seven children fulfills the elements of murder and torture as stipulated in Article 9 of Law No. 26/2000 on the Human Rights Court.

Thus, Komnas HAM must fulfill its mandate as stated by Article 18 and Article 19 of Human Rights Court Law by investigating the Sinak case, which is suspected to be the cause of Makilon Tabuni’s death, while six of his friends are currently injured.

The Komnas HAM investigations are very important and urgent to obtain sufficient evidence regarding allegations of gross human rights violations.

“To reveal the truth behind what the TNI called a ‘hoax’, the Komnas HAM must investigate the Sinak case immediately,” he said. (*)
